The ensuing terminology pertains to these Terms and Conditions, Privacy Statement, and Disclaimer Notice, as well as all agreements: “Client,” “You,” and “Your” pertain to the individual accessing this website and adhering to the terms and conditions set forth by the Company. “The Company,” “Ourselves,” “We,” “Our,” and “Us” designate our corporate entity. “Party,” “Parties,” or “Us” encompass both the Client and ourselves. All terminologies herein pertain to the offer, acceptance, and consideration of payment essential for engaging in the process of providing assistance to the Client.   1. The act of submitting this registration form to Rose Garden Housing Scheme, irrespective of whether payment is included or not, shall be considered as the formal expression of intent by the client to enroll as a customer of Rose Garden Housing Scheme.
  2. The precise location and coordinates of plots will be provided promptly once your application is accepted and officially approved by Rose Garden Housing Scheme.
  3. In the event of an application being declined, whether by Rose Garden Housing Scheme or by the client. The applicant’s corresponding registration shall be formally canceled.
  4. Allocation of possession will occur upon the completion of half of the installments, which is approximately after 2 years.
  5. Ownership of the plot will be transferred to you upon the completion of full payment and all requisite legal processes.
  6. Clients are required to ensure timely deposit of the specified installments, which must be made before the 10th day of each month through a bank account or via EasyPaisa / JazzCash.
  7. The client is obligated to make 2 equal partial payments during each year of the 4-year installment period.
  8. Installments received after the specified due date from the allottees/applicants will be accepted only with a surcharge of 1.5% per month (equating to 0.05% per day) as per our formal policy.
  9. If any allottee fails to make payment for two successive installments within the prescribed period. It is formalized that the allotment is subject to cancellation.
  10. In the event of an allotment cancellation by Rose Garden Housing Scheme. Any payments submitted will be refunded with a 25% deduction, without any additional profit, interest, or markup. It’s important to note that the processing fee already paid remains non-refundable.

  12. Any discount, when formally announced by Rose Garden Housing Scheme, will be provided to the respective applicant and appropriately incorporated into the final installment of dues related to the allocated plot. This adjustment will include the Registration Fee that has already been remitted.
  13. Once a plot has been allotted or transferred, it cannot be surrendered or requested for cancellation by the applicant, and all payments made in relation to it shall be deemed as Non-Refundable but the plot can be canceled by the Rose Garden Housing Scheme.
  14. A plot allocated to an applicant shall only be utilized by the allottee for the specific purpose for which it was applied or designated.
  15. The society retains the authority to make alterations to the location, size, and dimensions of plots as necessitated by modifications to the layout plan, without the obligation to provide prior notice.
  16. Construction on the plots is limited to the pre-approved elevation provided by Rose Garden Housing Scheme for the respective plot. Any additional construction or modifications to existing structures are strictly prohibited without prior approval from the Company.
  17. In the event of any extra area beyond the allotted size for a plot, a proportionate additional amount will be charged in addition to the total amount. Conversely, if there is a shortfall in the area, the proportionate amount will be adjusted accordingly.
  18. The transfer of a plot allocated to an applicant shall be permitted only upon the receipt of updated payments and charges. All registration and mutation charges associated with the transfer shall be the responsibility of the allottee.
  19. In the event of a plot transfer, the initial allottee is obligated to settle all outstanding dues owed to the Company up to that point before the transfer can proceed.
  20. The allottee is responsible for covering all registration and mutation charges, as well as any applicable government taxes.
  21. Rose Garden Housing Scheme holds the authority to allocate or sell a plot that has been canceled from the name of the allottee due to nonpayment of dues or any other reason, to any other applicant or individual.
  22. The previous allottee shall not possess any claim or entitlement to such a plot. The decision of Rose Garden Housing Scheme in this matter shall be conclusive and binding.
  23. Development charges encompass the costs associated with internal development, including roads, footpaths, main water supply, and sewerage. However, they do not encompass the expenses or charges related to the provision of electricity, sui-gas, telephone services, construction of mosques, maintenance, transportation systems, and similar utilities. Charges for utility and services will be acquired at a later stage.
  24. In addition to the mentioned dues and any other payments required by applicable laws. The allottee shall be responsible for paying escalation and other charges at the rates determined by Rose Garden Housing Scheme periodically to account for increases in the cost of raw materials.
